Russet Communications LLC (Russet) warrants to the
original purchaser that the individual products are free from defects in material and
workmanship, and conform to the original manufacturers specifications when purchased.
Russet makes no such warranty if non-standard accessories or parts are attached or used,
used in any way in non-fitness for purpose, or operated outside of normal operational
parameters.
If any product fails to meet the warranty set forth
above during the applicable period, Russet shall repair or replace such defective product
in thirty (30) days of the receipt of the same. No product may be returned without the
authorization of Russet. The buyer will pay all shipping and handling charges to the
authorized repair center, and Russet will return units prepaid at its expense if the
product is covered by warranty.
This warranty is void and Russet will not be obligated
to replace or repair any Products if:
- the Product has been used in other than its normal and
customary manner;
- the Product has been subject to misuse, accident,
neglect, damage, or has been used with non-standard parts and accessories and equipment;
- doing unauthorized repair or replacement with unapproved
parts;
- the buyer fails to advise Russet of the failure during
the warranty period;
- force majeure and other acts of God.
Certain warranties may or may not be extended to the
purchaser, and may or may not be passed along to the final purchaser. Any warranty that is
passed along to the final purchaser does not obligate Russet to fulfill any warranty. The
final purchaser must request copies of warranties.
The aforesaid warranties are in lieu of all other
warranties expressed and implied, including, but not limited to, any implied warranty for
merchantability of fitness for a particular purpose. Russet is not liable for any
consequential, incidental, indirect or exemplary damage whether on the basis of
negligence, strict liability or otherwise.
Exceptions to the warranty are tuning and adjustments
to the Products to meet new specifications or purposes, batteries that have not been
properly conditioned, antennas, expendable parts, hidden or secondary damage,
re-engineering for a new requirement or set of conditions, changes in performance required
by the Federal Communications Commission, type acceptance or addition of special testing
beyond the tests originally provided, or alteration of markings of product and its
components.
